⚠️ “I’ll do your réexamen” — beware of fraud
Translated from Bengali.
(Learn the real procedure for applying for asylum/réexamen in France)
In France, many people come to seek asylum (asile) because of war, political or religious persecution, or personal safety reasons. This is a humanitarian and legal protection system, not a business.
But in reality, some fraud networks take thousands of euros from newcomers by saying, “I’ll do your réexamen, I’ll make up a story, 100% guarantee.”
The reality is —
No one in France can guarantee asylum.
🇫🇷 The real procedure for applying for asylum (Asile) in France
1️⃣ Registration at the Préfecture / GUDA
If you want to apply for asylum in France, you must first go to the GUDA (Guichet Unique pour Demandeurs d’Asile).
Here:
• your fingerprints are taken
• it is checked whether you have previously applied in another EU country (Dublin regulation)
• you are given
Attestation de demande d’asile
📜 Legal basis:
CESEDA Article L.521-1
2️⃣ Submission of the OFPRA file
After registration, you must apply to OFPRA.
Usually, the form must be sent within 21 days.
In this file, you must write:
• your identity
• what happened in your country
• why you are afraid to return
📜 Legal basis:
CESEDA Article L.531-15
3️⃣ OFPRA interview
OFPRA conducts an interview to examine your file.
In this interview:
• your personal events
• the reasons for persecution
• the situation in your country
detailed questions are asked about these subjects.
📜 Legal basis:
CESEDA Article L.531-12
4️⃣ OFPRA decision
After reviewing the interview and the file, OFPRA gives a decision:
✔ Statut de réfugié
✔ Protection subsidiaire
❌ Refus
📜 Legal basis:
Convention de Genève de 1951
CESEDA Article L.511-1
5️⃣ CNDA appeal
If OFPRA rejects the application, the applicant can appeal to the CNDA (Cour Nationale du Droit d’Asile).
Usually, the appeal must be made within 1 month.
📜 Legal basis:
CESEDA Article L.532-1
⚖️ What is réexamen / Réexamen?
If someone’s asylum application was previously rejected and later new important information or evidence is found, they can apply again.
This is called a réexamen de demande d’asile.
📜 Legal basis:
CESEDA Article L.531-41
But the important point here is:
➡ there must be new evidence or a new event
➡ if the same story is submitted again, it is generally not accepted.
⚖️ Why making up a false story is dangerous
If an asylum file contains false information or a made-up story, the application may be rejected.
📜 CESEDA Article L.531-27
⚖️ Penalties for committing fraud
If someone takes money in the name of arranging asylum, this may be Escroquerie (fraud).
📜 Code pénal Article 313-1
The penalty may be:
• up to 5 years’ imprisonment
• a fine of 375,000 euros
💬 Final word
Asylum is not a business.
✔ If you have a true story, that is the most important thing
✔ No broker or individual can guarantee asylum
✔ “Making up a story” can put your future at risk
